- Abstract
- IA 2015 제9조~제11조의 제정으로 인하여 과거 영국 보험법과 관련하여 주된 비판대상이었던 워런티 관련 엄격한 법원칙은 폐기·수정되었으나, 이 조항이 MIA 1906 상 해상묵시워런티에 대해서도 동일하게 적용되는지 여부 및 그 구체적인 법적 효과에 대해서는 의문으로 남아 있다. 이 논문은 법리적 관점에서 IA 2015 제9조~제11조가 MIA 1906 상 해상묵시워런티, 특히 감항성 및 적법성 워런티에 대하여 적용되는지 여부 및 적용의 효과를 분석하는데 목적을 두고 있다.
