| dc.description.abstract | 이 논문은 최근 문헌 및 판례연구를 중심으로 법리적인 측면에서 원 B/L과 상당히 구분되는 스위치 B/L의 법적 특성을 분석하는데 그 목적을 두고 있다. 이와 관련하여 스위치 B/L의 발행과 관련하여 화주가 모색하는 상업적인 목적을 고찰하고, 스위치 B/L의 법적 효력과 관련하여 외국 판례법에서 요구하고 있는 전제요건, 스위치 B/L의 발행이 원운송계약의 효력 및 국제조약의 적용에 대하여 미치는 효과를 분석한다. 이에 근거하여 운송인이 직면하는 잠재적인 리스크의 실체를 규명하고, 리스크의 예방 또는 경감을 위한 해결방안을 제시하고자 한다. | - |
