| dc.description.abstract | 국제물품매매계약에 관한 UN협약(United Nations Convention on Contracts for the International Sale of Goods) 제80조는 채무자의 불이행이 채권자의 작위 또는 부작위에 기인한 경우 채무자의 면책을 규정하고 있다. 본 연구는 작위 또는 부작위에 대한 판단기준과 적용범위, 불이행이 두 당사자에 의해 초래된 경우 제80조의 적용 여부와 당사자 간 책임 배분, 입증책임 등에 대해 면밀히 고찰한다. 그리고 제80조가 적용된 사례분석을 통해 실무적용상 유의점도 제시하고 있다. 이를 통해 국제물품거래에서 발생할 수 있는 면책과 관련된 분쟁을 예방하고 실무자들이 제80조를 이해하는데 이론적ㆍ실무적으로 활용할 수 있는 유용한 지침을 제공하는데 연구의 목적을 둔다. | - |
