대외무역법상 전자적 형태의 무체물관련 주요쟁점에 관한 고찰

Abstract

The purpose of this paper is to examine the transaction trend and some issues relating to the electronic intangible goods, and propose its improvement plans. For these purposes, this paper is organised as follows. Chapter I introduces the necessities and purposes of this paper. Chapter II considers the concepts of the electronic intangible goods, and analyzes the related to law of electronic intangible goods. Chapter III considers the provisions of the electronic intangible goods in the Korea Foreign Trade Act. Chapter IV analyzes some issues related to the electronic intangible goods in Korea Foreign Trade Act, and suggests its improving plans. In conclusion, It is necessary that we should clarify the definition of the terms, scope, and classification criteria of the electronic intangible goods, and find the reasonable methods for confirmation and certification of the electronic intangible goods' transactions. And it is necessary to enact an independent law concerning electronic intangible goods.
