A Study on the Consistency Between Korea's Personal Information Protection Act and International Norms in the Digital Trade Era

초록

This research aims to present practical directions for institutional improvement by conducting an in-depth comparison and analysis of the structural and specific consistency between Korea's personal information protection laws and various international norms, and to propose countermeasures for establishing international trade strategies. With the expansion of digital trade, discussions on cross-border transfers of personal information are essential. Therefore, this study examines the impact of personal information protection on trade policy in the digital trade environment, the characteristics of digital trade, and the shifting global trade order. Furthermore, it compares and analyzes personal information protection provisions in major countries and international norms to systematically examine potential conflicts and harmonization with international norms. The results showed that South Korea's Personal Information Protection Act (PIPA) boasts a robust data subject-centered protection system, securing a level of normative credibility similar to the EU's GDPR. However, there is a structural gap in the flexibility and practical operational capabilities required by digital trade agreements. Therefore, ensuring consistency between South Korea's personal information protection laws and various international norms is crucial.
