뒤르케임의 도덕과학과 법의 도덕성- 인권 사회과학의 지평 -
초록
This study reviews Durkheim's sociology of law and science of morality, which emphasizes the morality of law, from the perspective of ethical naturalism, shedding new light on their theoretical implications for human rights. Specifically, this paper undertakes the following detailed tasks: First, by examining Aristotle's theory of happiness, which has influenced Durkheim’s thought, it reveals that Durkheim's science of morality is a revised version of neo-Aristotelian ethics. Secondly, by reviewing Quid Secundatus Politicae Scientiae Instituendae Contulerit (Durkheim, 1892), this study examines Durkheim’s science methodology as it applies to law and social science. Third, it discusses how Durkheim’s science of morality, based on the ideals of human dignity and the historical progress of moral individualism, can be effectively integrated into interdisciplinary approaches of human rights, transcending the intellectual division between law and social science.
