대학 외국인 유학생 규정의 문제점과 개선방향

초록

This study explored the legal limitations of international student support and directions for improvement by analyzing university regulations that directly affect international students in the absence of the international student-related legal system. Under the current Higher Education Act and the Foreigners Treatment Act system, universities comprehensively regulate the admission, study, life, employment, and settlement of international students through school regulations, but most of the regulations remain at the center of 'management and control' and are not in line with the population crisis and changes in immigration policy paradigm in the 2020s. Therefore, this study proposes the direction of improvement of the regulations for international students, first, the transition from 'management' to 'support' in the regulatory name, second, the stipulation of equal treatment for international students, third, the establishment of a provision for mutual culture understanding education obligations, fourth, support for job start-ups and settlements, and reinforcement of local government cooperation regulations, and fifth, the policy participation and feedback functions of international students. Furthermore, the need to amend these laws was raised because the limitations of these university regulations are not a problem of individual universities, but because they stem from the lack of national legislation levels such as the Foreigners Treatment Act and the Higher Education Act. This study is meaningful in that it has expanded existing research centered on central government policies or individual cases to the legal and institutional aspects of universities. However, there is a limit to the analysis of regulations centered on national universities, and it is necessary to conduct a comparative study reflecting the type of university establishment and regional characteristics in the future and to evaluate the effectiveness of actual support policies.
