Problems and Prospects of Outsourced Management for Multi-Unit Buildings

초록

This study examines the critical legal issues surrounding the outsourced management of condominium buildings under the Korean Act on Ownership and Management of Condominium Buildings and multi-family housing under the Korean Multi-Family Housing Management Act, which is essential for ensuring professional and efficient property oversight. First, regarding the legal nature of management entrustment contracts, this paper emphasizes the urgent need for modernized "standard contracts." While judicial precedents generally categorize these contracts as mandates (위임/委任), the scope of settlement obligations varies depending on specific contractual terms. Given the practical reality where fixed-price and cost-reimbursement systems often overlap, it is necessary to propose standard contracts that allow parties to clearly recognize and choose between elements of a contract for work (도급/都給) and a mandate. Second, this study confirms that the Korean Supreme Court has established reasonable standards concerning the vacuum of authority and conflicts that arise during the transition of management rights from the person who parcels out a building to the managing body. It suggests that sectional owners should proactively utilize systems such as the appointment of ad hoc managers to promptly establish self-governance structures. Third, the study calls for clear guidelines regarding the scope of liability for managing bodies and councils of occupants' representatives under the Korean Serious Accidents Punishment Act. Current judicial trends impose liability based on the degree of actual supervision and control; however, this may perversely incentivize managing bodies to neglect safety oversight to avoid legal responsibility. Ultimately, the advancement of condominium and multi-family housing management begins with the establishment of transparent legal relationships. To protect the rights of sectional owners and maintain property value amidst rapidly evolving precedents and tightening safety regulations, continuous legislative and institutional efforts must be made to clarify the authorities and responsibilities among the various stakeholders in outsourced management.
