외국인 유학생 관련 법제의 현황 및 과제

초록

This study examined how appropriate the current legislation in Korea is to attract foreign students to employment and settlement in Korea after graduation. First, the current status of the legislation for foreign students in Korea was examined, and legal and institutional tasks that need to be resolved from the perspective of domestic employment, settlement, and social integration of international students were presented. To this end, we reviewed laws and related policy literature related to foreign students, foreign laws and policies, and previous studies at home and abroad. As a result of the analysis, the international student-related legislation lacked support from international students as migrants, and was defined as a control perspective rather than support, so there was a limit to the employment, settlement, and social integration of international students. The study proposed the following tasks. It proposed discussing the constitutional provisions of the value regulation of joint development with migrants, establishing special provisions for international students in the Immigration Control Act and the Treatment of Foreigners Act, establishing a new regulation for employment support for international students in the Higher Education Act, establishing a basis for disclosing information on the employment rate of international students in the Education Institution Information Disclosure Act, and revising the Civil Service Examination Appointment Decree for international students to enter public office. It also insisted on the revision of university school regulations and ordinances in the direction of employment support for international students and social integration. This study is expected to contribute to the expansion of related research by examining the overall status and problems of the legislation related to foreign students from a holistic perspective, and to establish a legal and institutional foundation for foreign students to settle stably in Korean society and contribute to national development.
