Rational Regulatory Framework for Internet-based New Media

초록

Modern people are living in a world connected to the Internet. In the layered structure of the real and virtual worlds, which are the objects of our recognition, information is acquired and communicated through a flood of digital information. The amount of information has increased, and the speed of communication has accelerated, but it is questionable whether the content has been accurate and whether wise insights have emerged. To enhance the publicity and accountability of Internet newspapers, we reviewed the significance and requirements of these publications, aiming to propose reasonable regulatory measures that comprehensively consider the media environment and overseas legislation in Korea. In a situation where the proportion of media such as Internet newspapers is increasing, it should not be left as a blind spot of discipline, but an appropriate regulatory mechanism should be prepared. Democratic public opinion formation will be possible only when efforts such as the revitalization of self-regulation and raising citizenship are made in parallel with legal and institutional improvement. The Internet is evaluated as a significant technological progress that has occurred in recent years in the history of mankind. Although there is a temperature difference between the US and the EU in regulating this, it would be desirable to understand that self-regulation and national regulation should be improved in parallel, not an alternative matter. In addition, new media such as Internet newspapers are more influential than traditional media, but concrete measures to realize the value of publicity, truthfulness, and neutrality of the media are insufficient. Regulations on Internet media companies might be transformed into "governance of the media", but it is urgent to come up with a reasonable regulatory framework to ensure the publicity and independence of the media from the influence of Internet platform companies. In the case of imposing legal responsibility for hate expression and disinformation(false and manipulate information), it is necessary to subdivide it to specify the duty of care and responsibility of online service providers such as Internet newspapers and portal companies. Since there is a risk of suppressing "freedom of expression" even when regulating hate expression and fake news, it is necessary to prepare a reasonable regulatory system by comprehensively reviewing the judgment on whether it corresponds to hate expression and false manipulation information, the duty of care to check the truth of the content, immunity requirements, and (proportionate) sanctions corresponding to misconduct and responsibility.
