dc.description.abstract近年来,高校学术不端乱象再一次走入社会公众的视野,实务中因学术不端行为而引发的侵权纠纷案件数量亦呈逐年上升的态势。本文尝试以知识产权法的视角作为切入点,并具体结合裁判数据可视化分析、近年来热点案例和社会舆情热点,给予现阶段学术不端行为以合理界定,厘清学术不端行为和著作权侵权之间的法律关系,剖析现行高校学术不端论文检测机制存在的固有缺陷。在本文的最后是笔者结合实务和法哲学理论就该法律问题引发的一些思考。中国理应进一步优化学术不端检测系统,论文相似度检测数据是认定学术不端行为的重要证据而非唯一根据。不仅应加强学术成果检测提供者和使用者的监管,更应严格出版发行者对学术论文成果的规范审查义务。社会公众特别是大学生和专家学者群体理应认识到智力劳动成果背后的价值,严格规制学术不端行为有重大法律和社会意义。-
