| dc.description.abstract | 영국의 경우 2015년 보험법(Insurance Act 2015)의 제정 이전 사기적인 보험금청구에 적용가능한 법원칙 및 그 구제수단에 관한 법원칙이 상당히 복잡·불확실하고 혼란스러운 상태였다. 영국 법률위원회는 입법을 통하여 복잡하고 혼란스러운 판례법의 입장을 명확히 천명 또는 재정립함과 동시에 법적 불확실성을 해소하고, 관련 법률의 일관성 및 투명성을 제고할 필요가 있다고 판단하였고, 그 결과로서 IA 2015 제12조가 제정되었다. 이 논문은 사기적인 보험금청구에 대한 구제수단과 관련하여 LC가 법률제정과정에서 영국 의회에 제출한 일련의 보고서, 최종 법안 및 최신논문에 관한 문헌연구를 중심으로 구제수단에 관한 일반원칙을 천명하고 있는 IA 2015 제12조의 법적 의미를 분석하는데 그 목적을 두고 있다. | - |
