| dc.description.abstract | 우리나라는 중국과 일본 등과 같은 근거리 무역에서 Surrender B/L의 사용 비중이 크게 증가함에 따라 이에 대한 법적 분쟁이 빈번하게 발생하고 있다. 따라서 본 논문은 Surrender B/L에 따른 해상운송인, 계약운송인, 실제운송인, 하청운송인의 법률관계를 분석하고 우리나라 대법원, 중국과 일본 법원의 판결의 법리적 해석을 규명하였다. 해상운송인이 송하인에게, 실제운송인이 계약운송인에게, 실제운송인이 송하인에게 Surrender B/L을 발행하고 있는데 선하증권 원본으로 Surrender B/L을 발행한 경우에 한해서 하청운송인은 Surrender B/L에 명시된 이면약관에 대한 권리를 주장할 수 있다. 하청운송인은 선하증권 사본으로 발행된 Surrender B/L이 선하증권 이면에 명시된 자신들의 권리를 보호하지 못한다는 것을 전혀 모르고 하청운송업무를 이행하고 있다. 해상운송실무의 이러한 현행 업무처리방식은 조속히 선하증권 원본으로 Surrender B/L을 발행하는 방식으로 개선, 정착되어야 한다. | - |
