- Abstract
- 보험계약과 관련하여 손해방지비용의 보상에 관한 명시조항이 존재하는 경우에 명시조항의 강제력은 인정되고, 손해방지비용에 관한 보험자의 보상책임 유무 및 보상범위는 계약조항의 해석문제로 귀결된다. 다만 보험계약 상 명시조항이 없는 경우, 손해방지비용에 대한 보험자의 보상책임 유무 및 보상범위(보상한도)에 관한 영국 판례법의 입장은 상당히 혼란스럽고 불확실한 상황이다. 따라서 본 논문에서는 보험계약 상 명시조항이 부재한 경우, 손해방지비용에 대한 보험자의 보상책임에 관한 법적 근거, 보상원칙 및 보상범위와 관련하여 현재까지 영국 법원이 취하고 있는 입장을 분석하고자 한다.
